Can an employee on disability or medical leave be fired?
Ontario Employment Law FAQ
Can an employee on disability or medical leave be fired?
Yes and no. While an employee on medical leave or disability can be terminated, the employer would have the very difficult time of having to prove to the Human Rights Tribunal that the reason for termination was in no part because of the disability or medical issue.
